Immigration Consultation

There's a standard process described for filing non-immigrant Visa applications and petitions. Non-immigrant Visa is a mandatory Visa for every career aspirant who wish to work with the U.S. company and appearing before U.S. Consulate office abroad and formally requesting the issuance of a Visa. The issue of Visa is at the discretion of the Consulate Officer, which means they may disapprove your application for any reason.

Visa Waivers

Whereas citizens of other countries are permitted to travel and enter the United States as a visitor for 90 days or less and meet certain specific requirements. However, Canadian citizens do not require Visa permissions to enter the United States. But, they must show proof of eligibility for the non-immigrant category in which they claim eligibility.

Visa Petitions

There are certain non-immigrant Visas that require Visa petition approval through the USCIS before a Visa may be issued. An applicant for Visa in this category requires a qualified Visa petitioner to file a petition with the USCIS before any further action is initiated. Only after the petition is approved, the individual can apply for a Visa in the following category.

  • H - 1 B
  • H - 2
  • H - 3
  • K, L, O, P

For Permanent Workers, the following Visa category process is prescribed:

  • EB - 1
  • EB - 2
  • EB - 3
  • EB - 4
  • EB - 5

Visa Validation

For travel purposes, a new Visa may not be required. If you are planning to visit countries like Canada, Mexico, Cuba or any certain proximity islands for 30 days or less, in such case travel is permissible and can return with valid non-immigrant status. This process is called as "automatic Visa revalidation" .

Non-Working Visas

If you are visiting the United States for tourism, you need a valid Visa called as B2 Visa.

Working Visas

Anyone entering the United States for the purposes of work must present a working type of Visa at the port of entry.

Change of Status

Sometimes, you are permitted to move from one Visa category too another and this process is known as change of status.
